General Policies (Part I)

Definitions:

A Class is a Single Class, Private Class, Course or Workshop​

A Drop-In is when an individual makes a reservation for an art experience or comes to the studio without prior notice.

An Event is a Private Party, Corporate Event or Special Event organized by the studio.

CLASS POLICIES:

REGISTRATION AND CONFIRMATION

Your spot in the class or program of your choice will be saved only upon registration and payment. Payment and registration are only processed if there is room in the course. Upon registration and payment, The Muse ArtHouse will confirm your registration in the class of your choice. If you sign up for a class or program that is already full, we will automatically place you on our waiting list and advise you towards another class that suits your needs and creative interests. 
 

PRORATED ART CLASSES

Full-session classes that have not begun yet are not prorated. If you know in advance that you will not be able to attend a class during the upcoming session, the class fee does not change.
 

PAYMENT

Full payment and registration is required in order to reserve a spot in the class or program of your choice. We accept credit cards, debit cards, cash, checks or Zelle. There is a $50 charge for returned checks.

 

CANCELLATION POLICY

For all classes, you must cancel 48 hours in advance of the class (or the first class in the series) to receive a refund minus a 5% processing fee or a credit for the full amount. Credits must be used within 6 months or they expire.

Although class cancellation by The Muse ArtHouse is quite rare, The Muse ArtHouse reserves the right to cancel classes or change instructor assignments and makes every effort to notify students in advance. If enrollment goals are not met, a course may be cancelled up to 48 hours before the first scheduled class. In the event of cancellation, a full refund or credit is granted. On occasion, a course start date will be pushed back if enrollment goals are not met. In this instance, you will receive a credit for the price of the class that did not take place or it will be applied to the rescheduled class. Credits must be used within 6 months.
 

ART MATERIALS

The Muse ArtHouse does not provide supplies for your class or program unless it is clearly noted in the description. Courses and programs that include materials are noted clearly. After full registration, you will receive a materials list for your class prior to your class start date. You are responsible for bringing your materials; materials are not stored at The Muse ArtHouse. Works in progress (wet canvases or large paper) may remain at The Muse ArtHouse between weekly sessions with your name on it. We are unable to store canvases or materials larger than 36” on any side. The Muse ArtHouse is not responsible for lost, stolen or damaged items.


MAKE-UP CLASSES

If a registered student misses a class or classes for any reason, either personal or professional, we DO NOT offer a “make up” cla‌ss. On rare occasions, we may consider medical emergencies an extenuating circumstance. Please speak with management if this situation arises.

 

EVENT POLICIES:

SCHEDULING AND PAYMENT

Private parties and corporate events are based on availability and advanced appointments only. We require a 50% non-refundable deposit upon booking to hold the date for your events. We require full payment 48 hours prior to your event to avoid cancellation. Once you have contacted The Muse Art House with your preferred date/time/instructor, we will do everything possible to accommodate your scheduling needs. We suggest providing three possible time slots in order for us to serve your needs best.
 

CANCELLATION POLICY

Private parties and corporate events require 10 business days advance notice for cancellations or rescheduling. We will do the best we can to accommodate your scheduling needs. We charge a $150 rescheduling fee, and all deposits are non-refundable. Cancellations within 10 business days of your event are non-transferable and non-refundable. If the event is rescheduled due to extreme weather circumstances, no rescheduling fee will apply.

GIFT CERTIFICATES

Gift cards and gift certificates, once purchased, cannot be returned nor refunded
 

REFUNDS & CREDITS

Once registered for your art class or art program of choice, whether in-person or online, the following refund policies apply:

  • For all classes, you must cancel 48 hours in advance of the class (or the first class in the series) to receive a refund minus a 5% processing fee or a credit for the full amount. Credits must be used within 6 months or they expire.

  • For cancellations less than 48 hours in advance, you can receive a credit towards a future program. Credits must be used within 6 months or they expire.

  • For no-shows, there are no refunds and no credits.

  • Refunds are not provided for gift certificates or gift card purchases.

  • Refunds are not provided for private events of any kind.

  • Refunds will appear on your credit card in 6-8 weeks.

  • If you purchased through a third party, the above applies to your purchase, but the credit or refund will be issued by the third party. If we cancel a class that you purchased through a third party, you will receive a full refund or credit in accordance with our policies. You must contact the third party directly.
     

PROMOTION AND GIFT CREDIT CODES

If you have a promotion or gift credit code, they must be used and applied during the registration and payment process. Once a purchase is completed, such codes may not be applied retroactively. Refunds will not be provided retroactively in the event that a code is shared after payment has been made. We are not able to unregister and re-register students. We welcome students to use the codes you have for a future purchase.
 

INDIVIDUAL  RESPONSIBILITIES

The Muse Art House is meant to be a creative space of quiet enjoyment where our community members feel safe and supported and are able to pursue their artistic passions. All participants are expected to be responsible for themselves and respect the space, our policies and other community members. Verbal threats, foul language, or physical contact directed at any employee or patron will not be tolerated. The Muse ArtHouse reserves the right to remove from its premises or exclude from membership or activities, anyone, in its sole discretion, it deems necessary, that violates our practices and policies or disrupts a program. All participants agree to conduct themselves in a controlled and reasonable manner at all times, and to refrain from using any equipment or materials in a manner inconsistent with its intended design and purpose. The Muse ArtHouse does not accept responsibility for children. If a child must be supervised, a parent or guardian must be present at all times.

PHOTOGRAPHS AND RECORDINGS

The Muse ArtHouse may record and photograph classes, events, parties and workshops for adults, teens and children for marketing, website, social media, archival and/or other purposes. Such recording or photography may include pictures of the attendees, individuals at our program, class participants or their work. Your attendance at any class, party or event at The Muse ArtHouse shall be deemed your consent to appear in such programming and/or photographs without compensation or additional approval of any kind.

Amendments will become effective at the time they are posted on our website. We will post notices of material changes in this Privacy Policy on our website.

Who Should Use This Website
Our website is intended to provide general information about our services, company, and business, including franchise opportunities, and to schedule workshops. You may also purchase gift cards, kits or completed projects through our website.

 

We do not knowingly solicit or collect data, including personal information, online from or market online to children under thirteen (13) years of age. If we become aware that a child under the age of 13 has provided us with personal information without consent of a parent or legal guardian, we take steps to remove such information. If you become aware that a child has provided us with personal information without consent of their parent or legal guardian, please contact us.

 

Do not use this website if you are under the age of thirteen (13) or do not agree to the terms in this Privacy Policy.

Collecting and Using Personal Information
 

Information That You Provide To Us.

When you register for a class, workshop, event or any other service, you will provide us with your contact information which may include your name, phone number, email address, social media usernames and your preferred means of communication. You may also provide us with information to personalize the projects or kits that you select to make in our studios or purchase online (such as your address, geolocation, name and the names of your family members and pets, birthdates, anniversary dates, your address and certain hobbies, occupations, or special interests you might have as well as images that you own the rights to). If you register for an in-studio workshop, you may provide additional special requests for accommodations or information such as seating preferences.

 

We use this information to confirm your registration and communicate with you about your registration, to prepare for your art experience, and to make your experience enjoyable. We will maintain your order history and the information that you provide in our records, and if you sign up for any of our loyalty programs, we will also use your order history information to track your purchases and manage your rewards if relevant.

 

Any name you use to reserve a workshop may publicly appear on our website and in-studio calendar. The information that you provide to us may be stored and used by The Muse ArtHouse, its affiliates, service providers, and franchisees wherever we do business, but only for the purposes described in this policy.

 

We will send emails, texts or other electronic communications to you to respond to your communications, confirm your bookings, purchases or orders (including sending receipts); and remind you of and provide information about upcoming workshops you have booked. Beyond these communications, we will only send emails or texts to you with your consent.

 

You have the opportunity to opt-in to receive newsletters, and information from us about promotions or new product offerings. You may opt out or unsubscribe from receiving communications that do not relate to a specific registration or order at any time using the link that is included in the communication sent to you.

 

Photos, or videos taken of you during or after a workshop, or of your completed project(s), may be posted on our website or on our social media pages. If you agree, you may be tagged in these photos.


When you register for a workshop or purchase refreshments during the workshop, or make a purchase through our website, you will provide payment information. All financial transactions are processed by third-party payment processors. We do not see, collect, retain, or store your credit card or other payment information.

Other Information That We Collect.

In addition to the information that you provide to us, we collect information using automated data collection technologies including pixels or cookies. When you interact with our website or open emails, these allow us to collect information that may include but may not necessarily be limited to your location, IP address, browser type, internet service provider, search queries, referring URL’s, actions taken on our website including dates and times of website visits, and similar data. We may link certain data elements we have collected through automated means, with other information we have obtained to let us know, for example, whether you have opened an email we sent to you. While you may be able to change your browser’s setting to block collection of certain data, please note that by doing so you may not be able to access all functions on our website.

 

We use Google Analytics to collect usage data, to analyze how users use our web site and to provide advertisements to you on other websites. For more information about how to opt out of having your information used by Google Analytics, visit https://tools.google.com/dlpage/gaoptout/.

 

You may follow us on our social media pages such as YouTube, Instagram, TikTok or Facebook. We cannot control the use of information gathered by those sites. The sites have their own privacy policies, and we urge you to review them. We may associate your usernames and information you post on social media sites with other information that we gather.

 

Retention
We retain the personal information we collect only as reasonably necessary for the purposes described in this Policy. For example, we will retain your information as long as necessary to fulfill your registrations and orders, to provide repeat customers with a high level of service, or as long as you participate in our loyalty programs. If you purchase gift cards from us, we will retain the personal information you provide for the purchase for a period of one year, but we will retain the gift card identification information indefinitely so that the gift card remains redeemable until used in accordance with our policies.

 

We also retain information as necessary to comply with our tax, accounting, and record keeping obligations, as well as an additional period of time as necessary to protect, defend or establish our rights, defend against potential claims, and comply with our legal obligations. In some cases, rather than delete your personal information, we may deidentify or aggregate it and use it in that form.

 

Information Sharing
We do not rent, sell or trade your information. We will use the information that we gather only for our business purposes as described in this policy, such as fulfilling your order(s) and registrations(s), improving our services and delivering a high-quality personal experience to you each time you participate in our classes, workshops, events, make a purchase, or interact with our website; to communicate with you about products, services, promotions or contests; to tailor our services to your interests; to respond to your questions; and to manage our loyalty programs.

 

We will only share personal information outside our company (1) with affiliates or franchisees who directly provide services or products to you; (2) with the service providers and suppliers we use to support our business such as professional advisors, advertising advisors, web-hosting providers, analytics providers and other information technology providers; (3) as required to comply with a valid legal or regulatory process; or (4) if we believe in good faith that such disclosure is reasonably necessary for our protection or that of other third parties. Third party service providers are contractually prohibited from using your data for any purpose other than providing services to The Muse ArtHouse.

 

If you have opted in to receive communications from us, we may provide your email address and state of residence to Google or Facebook. These social media sites may combine the information that we have provided with other information you have shared with them to show you ads or to reach an audience of people who might be interested in our services and products.

 

Information Protection
The privacy, security and integrity of your information is important to us, and we will take commercially reasonable steps to ensure it remains secure, and to prevent loss, misuse, alteration and destruction. However, no security system is fail-safe, and we cannot guarantee that unauthorized persons will never obtain the information you provide; guarantee protection against interception, misappropriation, misuse, or alteration; or guarantee that your information will not be disclosed or accessed by accidental circumstances or by the unauthorized acts of others. Furthermore, we have no control over the security of other sites you might visit, interact with, or do business with.

 

You should exercise discretion in what information you send to us electronically. We cannot guarantee that information sent over the internet is secure and will not be intercepted by others before it reaches us. We are not responsible for the security of information sent over the internet.

 

If you have any questions or concerns about your personal information; if you would like to opt out of our collection or sharing of your personal information; or if you would like to access, update, correct, amend, or delete any of the personally identifiable information we have collected, you may do so by emailing your request to info@themusearthouse.com. We will respond to your request within fourteen (14) days of receipt.

 

We will need information to process your request so we can determine if we have personal information, to communicate with you, or to advise whether your request could affect your participation in our loyalty programs or your full access to the features on our website. Please be aware that there might be circumstances in which we may not honor your request, for example because we cannot verify that we have your personal information or if an exception applies.

 

Privacy Rights Under Certain State Privacy Laws
You may also have certain privacy rights under laws enacted in your state (“State Privacy Laws”). Under some State Privacy Laws, residents have rights including the following: (1) to understand whether their personal information is being gathered, and what personal information is being gathered, (2) to request and receive a copy of their personal information in a usable format, (3) to request that their personal information be corrected or deleted, and (4) to request that certain transfers or sharing of their personal information be stopped.

 

Whether you email or phone us, we will need information to process your request so we can confirm your residency, determine if we have personal information, and to communicate with you.
